In advance of 1 January 2025 when the FuelEU Maritime Regulations will really kick in, BIMCO has published a Clause that owners and charterers can adopt to address these complex regulations in a commercial context.
Including a clause in your charter party to address the FuelEU Regulations is vital, given the ultimate liability under the Regulations will sit in the first instance with the shipowner (or where the shipowner has passed on the duties and responsibilities imposed by the International Management Code for the Safe Operation of Ships and Pollution Prevention to a third party, often the ship manager, then with that third party).
